Terms & Conditions for Members
  1. These detailed Terms & Conditions for Lifeline Healthcare Consultancy & Services hereafter called Lifeline shall constitute the agreement (the “Agreement” or “T&C”) between Lifeline (Registered office at 112 B Block, SLV Defence Gallari, Dwaraka Nagar, Kattigenahalli, Jala Hobli, Yelahanka, Bangalore- 560063 and the registered individual user who subscribes for a one, two or three year membership issued by  or any service on offer from Lifeline.
  1.  A Lifeline Member is defined as an individual who has a valid and current Lifeline Membership issued/approved by Lifeline. Lifeline member is obligated to pay directly to the service provider for all paid services on offer. He opts for and may receive a concession from those medical service providers who are empanelled with Lifeline as per the agreement between Lifeline and the service provider.
  1. The details of the benefits of ‘Lifeline Membership have been provided to the member. The Terms &Conditions, Lifeline Membership, Membership Card, the services empanelled with Lifeline & the offers made on the Lifeline Membership Card may periodically change. Hence, we request you to check for these changes on the website or by calling us on our help line numbers on a regular basis.
  1. The benefits of the Lifeline Membership are not transferable in any manner, whatsoever & the Lifeline Membership cannot be used by any person, other those registered.  In case you need any information on healthcare concerns or policies, Lifeline help desk representative will be happy to guide you regarding the various options that would be suitable for you. The Lifeline routine information and assistance enquiry helpdesk is operational between 8 am – 8 pm save except on national holidays. Any messages received prior to 8 am would be addressed on the same day. Messages received after 8 pm would be addressed the next working day. Members requiring attention beyond 8 pm are requested to call up on mobile number provided to the member emergency services would be available round the clock seven days a week including public and national holidays.
  1. Whenever you wish to avail a service, please identify yourself as a Lifeline member upfront before undergoing the treatment. It is compulsory to show your Lifeline Membership card to the empanelled doctor in advance, before undergoing treatment for availing the associated benefits. Please discuss all treatment/consultation costs before starting the same. In case you are not satisfied, you may call the Lifeline help line for seeking guidance or submitting the feedback. There could be some treatments & services on which the empanelled medical practitioner may not be able to offer concessional rates. Benefits available on Lifeline Membership cannot be used in conjunction with any other benefits/promotional offer/discount/loyalty scheme that may be offered by a medical practitioner. All offers by the practitioners are for services and treatments within doctor’s clinic/laboratory premise. Any associated treatment or service outside the premise or given by any other practitioner is not covered under the concessional program that the doctor/clinic has signed for. Medical practitioner empanelled with Lifeline may change from time to time, so it is advisable that you call the Lifeline helpdesk and confirm whether a particular medical practitioner continues to be part of the network. Lifeline has tried, on a best effort basis, to have a wide variety of empanelled healthcare facilities, so that all your medical needs can be taken care of. However, occasionally there may be situations wherein, a suitable medical facility or certain medical services might not form a part of the network.
  1. Lifeline do not undertake any responsibility or guarantee for any treatments, services & procedures advised by the medical practitioners. The choice of following any such guidelines is entirely at your discretion. Usage of the Lifeline membership Card by the card holder (Lifeline Member) implies that the card holder agrees to the following terms and conditions of service & other terms as incorporated herein and understands that these terms govern the use of Lifeline Membership. All Lifeline members are understood to have read (on their own behalf and on behalf of their dependents/family/other members) the following terms and conditions and agree to abide by these Terms of Use. Lifeline reserves the right to modify, alter or otherwise update these Terms at any time and all cardholders agree to be bound by such modifications and/ or updates. Lifeline Members are entitled to receive certain free and/or discounted services from Lifeline Medical Partners who may be Independent Medical Professionals / Organisations / Institutions / Pathology Labs / Radiology Labs / Pharmacies/ Others. In order to receive medical services from such Lifeline Medical Partners, a Lifeline member must present his / her Membership card to the Lifeline Medical partner before services are rendered & agree to the applicable fee accordingly. Members must pay the Lifeline Medical Partner directly at the time of receiving the Service unless otherwise agreed upon between Lifeline Medical Partner and the member. If a member wishes to confirm the current fee for a particular medical service, he / she should first contact the Lifeline’s helpdesk number for guidance.
  1. Interaction with Medical Service Providers.   While Lifeline will try to ensure a confirmed appointment with a medical service provider (like doctor or diagnostic lab) for a member who has requested an appointment, Lifeline or its Partners do not guarantee that the user will get a confirmed appointment at the time of his choosing. Further, Lifeline and its Partners have no liability if such an appointment is confirmed but later cancelled, postponed or rescheduled by the hospital or medical service provider, or the medical service provider are not available as per the given appointment time.
  • Lifeline or its Partners may provide value added services which connect Users directly to the medical service providers via video call, voice call, text message, online chat or other electronic means and the information exchanged between the User and the medical service provider is stored and used in accordance with the Privacy Policy. However, it is at the discretion of the User, to avail such Service if it is available.
  • You understand and agree that any interactions and associated issues with other Users including but not limited to your health issues and your experiences is strictly between you and the other Users. You shall not hold Lifeline or its Partners responsible for any such interactions and associated issues and Lifeline will not be held responsible or liable for the same. For avoidance of doubt, the Services are not to provide any healthcare or medical advice or diagnosis and hence Lifeline and its Partners are not responsible for any medical or other outcomes between you and the medical service providers you interact with, pursuant to any interactions on the Website or App. If you decide to engage with a medical service provider to provide medical services to you, you do so at your own risk. Lifeline or its Partners shall not be responsible for any breach of service or service deficiency by any medical service provider you connect, engage or transact with using the Website or App. We advise you to perform your own due diligence or get feedback prior to selecting a doctor or any other service provider available on the Website or App.
(c)  Without prejudice to the generality of the above, Lifeline or its Partners will not be liable for:
  • any wrong medication or treatment quality being given by the doctor(s), diagnostic service provider(s), pharmacy(s), or any medical negligence on part of the any of the above;
  • any type of inconvenience suffered by the User due to a failure on the part of the medical service provider including doctor to make himself/herself available at the appointed time, no show by the doctor, inappropriate treatment, or similar difficulties;
  • cancellation or rescheduling of booked appointment or any variance in the fees charged;
  • any medical eventualities that might occur subsequent to using the services of a doctor, diagnostic lab services, pharmacy, whom the User has selected on the basis of the information available on the Website or App or with whom the User has booked an appointment or performed a transaction through the Website or App.
  • Lifeline shall not be liable, under any event, for any comments or feedback given by any of the Users in relation to the services provided by another User. All such feedback should be made in accordance with applicable law. The option of Users to give feedback remains at Lifeline’s sole discretion and may be modified or withdrawn at its sole discretion. Lifeline may moderate such feedback at any time. Lifeline shall not be obliged to act in any manner to give effect to the content of Users’ feedback.
  1. Members of ‘Lifeline may choose several health insurance policies that will be made available to them. This is a complimentary paid service which will be available to the members. The offer is designed for the benefit of Lifeline’s members, but it does not entail any liability on Lifeline the insurance cover, when opted for either the insurance coverage or any, is provided by the insurer. Any grievance arising out of claims and/or services related to the insurance cover shall be directly pursued with the insurer. Lifeline shall not be liable for any such claims. Lifeline is in no way responsible for any services provided by the health insurer in connection with the Insurance Policy.
  1. Membership Term. Once the initial “Membership Fee” is received by Lifeline, a member will be entitled to the avail the benefit of the Lifeline Membership during the Membership period as defined by the expiry date given on the face of the Lifeline Membership Card.
 
  1. Renewal of Membership. It is the responsibility of the member to ensure that Lifeline receives the payment for renewal of Membership at least two weeks prior to the Lifeline Membership Card expiry. Lifeline is not responsible and assumes no liability for any disruption of service in case the payment gets delayed or the payment cheques are dishonoured. In case of dishonoured cheques, a penalty shall be charged. The Membership card services will remain suspended till the realization of the payment.
  1. Renewal Charges. The charges for renewal can be confirmed by calling the Lifeline’s helpdesk, a month in advance of the expiry date. Kindly note that any benefits associated with the Membership shall not be available to the Lifeline Member, after the membership has lapsed. The renewal charges for the membership may vary from time to time.
  1. Card. Lifeline issues a e card by default which can be carried in any electronic device. A physical card will be issued at a nominal cost of 100/- per card (plus the applicable taxes). A duplicate Membership card may be issued at the same price in case of a lost card.  The tenure of the Membership will remain as specified in the initial Membership card.
  1. Grievances. Lifeline Members are advised to address their grievances, if any, to Lifeline representatives. However, if you are not satisfied, you may write to us at our registered office address or mail Lifeline at 24x7lifeline@gmail.com. The member’s rights or duties under this agreement may not be assigned or delegated without the prior express written consent of Lifeline. Lifeline Member agrees that he / she will use his / her Membership only for his / her personal benefit. The Member is solely responsible for paying directly to the Lifeline Medical Partner for all services rendered unless otherwise agreed upon by the Lifeline Member and Lifeline Medical Partner. Lifeline is in no way responsible for any services provided by the Lifeline Medical Partners. The Lifeline Membership Card provides the Lifeline Member access to a network of voluntarily participating medical professionals / dentists & other medical partners / vendors who are independent practicing professionals (deemed as “Lifeline Medical Partner”). Participating Medical providers are independent contractors in private practice and are neither employees nor agents of Lifeline and / or its parents, subsidiaries or affiliates. The availability of any particular provider cannot be guaranteed, and provider network composition is subject to change without notice. All medical services are the responsibility of the treating Lifeline Medical Partner only and to be carried out in consultation with the Lifeline Member. Selection of the specific Lifeline Medical Partner is finally the responsibility of the Lifeline Member and is not based on any representations or recommendations by Lifeline. Lifeline shall not be responsible in any case whatsoever for the services provided by the Lifeline Medical Partner. The term “Subsidised / Discounted Fee” means a service that is available to a Lifeline Member at a lower cost from fees normally charged by the provider and for which the Lifeline Member is solely financially responsible. The Lifeline Member understands that all payments to providers are due and payable at the time of service. In order to access reduced fee services, the Lifeline Member must present his / her Lifeline Membership Card & ID card to the Lifeline Medical Partner’s office at the time of his / her appointment. The Lifeline Medical Provider shall offer the subsidised/discounted rates on treatments and procedures managed and serviced by Lifeline Medical Partner directly (& not necessarily by other doctors, visiting or consulting doctors etc.) & within the Lifeline Medical Partner’s premise & under Lifeline Medical Provider’s management and not for any further treatment, check or service required elsewhere. It may not be necessary that all services, tests, medical fields, doctor types are covered by the Lifeline Membership Card & the Lifeline Medical Partner may not be able to provide subsidized /discounted service on select procedures, i.e. the subsidised/discounted services may not be offered on all treatments and procedures offered by the Lifeline Medical Partner or laboratory. Any existing and / or planned offer and / or package by the Lifeline Medical Partner may not be clubbed and the Lifeline Medical Partner may offer only one of the offers (either offer on Lifeline Membership card or existing packages) or on those services.
  1. The Lifeline Member should clarify all rates and fees before going forward for any consultation or treatment with the Lifeline Medical Partners & shall also clarify the discounted rates in advance (& all other details about the treatment or check up or test, etc.) & be satisfied about the same before starting the treatment. Lifeline shall not participate or be responsible for any dispute on the same (related to rates and discounted rates once the treatment has started & costs have been incurred). If a particular Lifeline Medical Partner does not offer the discounted rates as per the communicated discount, the member should contact Lifeline Helpdesk numbers & Lifeline will refer the member to another Lifeline Medical Partner. Lifeline will not be responsible for providing any compensation to the Lifeline member for the charges levied by the Lifeline Medical Partner. Lifeline does not give any warranty, express or implied, as to description, quality, fitness for any particular purpose, productiveness, or any other matter, for any services or merchandise purchased or received by a member from a medical partner, pathology lab / radiology lab/ provider or vendor through his / her card membership. in the event that any product or service purchased or received by a member is defective, or otherwise unsatisfactory, the member will deal directly with the provider, seller, merchant, vendor or manufacturer of the product or medical / dental service for any repair, exchange, refund or satisfaction of claim.
  1. Lifeline & the Lifeline Medical Partners who are part of the Lifeline Membership network reserve the right to revise their charges at any time. Lifeline member shall , for himself / herself, and on behalf of any family member who uses the services under the Lifeline Membership hereby forever releases, acquits and discharges Lifeline and its employees, officers, directors, agents and affiliates from any and all liabilities, claims, demands, actions and causes of action that such member or his / her legal representative(s) may have by reason of any damage or personal injury sustained as a result of or during the course of the use of any medical / dental service / Other services. Lifeline Membership offered services are not health insurance policies. The Lifeline Membership provides services through the Lifeline Medical Partners at certain health care centres or at your homes solely on your discretion. The Lifeline Membership holder is obligated to pay for all health care services from the Lifeline Medical Partners, who have contracted with Lifeline Membership for providing services under the empanelment agreement.
  1. The T&Cs and the relationship between you and Lifeline will be governed by the laws as applicable in India. Any disputes may be resolved through mediation/negotiation or arbitration in that order and will be exclusively handled in the competent courts of Bengaluru, India.
 
  1. Lifeline Cancellation and Refund Policy. This cancellation and refund policy (“Policy”) governs the cancellation of your Lifeline Membership (Registered office at 112 B Block, SLV Defence Gallari, Dwaraka Nagar, Kattigenahalli, Jala Hobli, Yelahanka, Bangalore- 560063 and of the Lifeline Membership Card issued by Lifeline as well as the refund of the fees paid by you towards purchase of Lifeline Membership (“Membership Fees”). In the event that you wish to cancel your Lifeline Membership and association with Lifeline, you shall be required to intimate the same to Lifeline by calling Lifeline or by sending an email to Lifeline Helpdesk within 45 calendar days from the date of membership.  You shall further be required to return the Lifeline card to our office address. On receipt of the same, Lifeline shall verify the details of your Lifeline Membership and process the request for cancellation placed by you. Once Lifeline is satisfied that your request is in accordance with this agreement, Lifeline shall discontinue the Lifeline Membership with immediate effect and issue a refund of the amount paid by you as Membership Fees subject to the following terms: Cancellations shall be considered only if (i) a valid request is made in this regard within 21 (Twenty one) calendar days inclusive of the date of membership. For calculation of the aforesaid periods, the records of dispatch, delivery and communications available with Lifeline shall be considered. Thereafter, the refund will be given to you within 21 days minus the applicable taxes and administrative charges. No request for refund will be entertained in case the Membership Card is returned or an affidavit duly notarised is submitted stating the same and giving an undertaking that the card will not be misused after termination of the membership.  Credit of the Membership fees to your bank account / credit card account upon cancellation and refund by Lifeline shall be as per policies and timelines followed by the banks involved and Lifeline shall not be responsible for any delays in this regard. You are understood to have read and agree to abide by this Agreement. All information in this communication is correct & updated as of the date of issue and is subject to change at the discretion of Lifeline. This agreement shall form an integral part of the terms and conditions governing the use of the calendar available on https://www.24x7Lifeline.com. Any cancellation of the Lifeline Membership, owing to a mis-representation/fraud/suppression of material facts/non-cooperation by Lifeline member, would result in the automatic cancellation of the membership with no refund what soever. No services of lifeline are to be availed by the member if he has sent intimation for termination.
  1. Lifeline Healthcare Consultancy & Services (referred to as “we”, us”, “Lifeline”) is the author and publisher of the internet resource www.24x7Lifeline.com and the facebook page www.facebook.com/24x7Lifeline  referred to as Website and webpage respectively on the world wide web and together referred to as “Services”. Lifeline provides the Services in partnership with its agents, affiliates, associates, representatives or other third parties (together referred to as “Partners”). Please go through these terms and conditions (“Terms”) available at https://www.24x7Lifeline.com/T&C carefully before you decide to subscribe to Lifeline membership or avail the Services made available by us. These Terms constitute a legal agreement (“Agreement”) between you and Lifeline in connection with your membership with Lifeline (defined below). The Agreement is published in compliance of, and is governed by the provisions of Indian law, including but not limited to:
  1. the Indian Contract Act, 1872,
  2. the (Indian) Information Technology Act, 2000, and
  3. the rules, regulations, guidelines and clarifications framed there under, including the (Indian) Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (the “SPI Rules”), and the (Indian) Information Technology (Intermediaries Guidelines) Rules, 2011 (the “IG Rules”).
  1. Data Privacy Policy. The terms “personal information” and “sensitive personal data or information” are defined under the SPI Rules, and are reproduced in the Privacy Policy.
(a)        Obligations that your dependents would have had had they maintained their own separate individual personal health record. (b)  If you provide access to your personal health record to anyone else, you are deemed to be responsible for all actions, access, transaction that that person takes related to your personal health record either on their own or independently. Lifeline or its Partners are not responsible or liable for any action, transaction, loss, leakage or any other liability arising out of this.
  1. Some of the content, text, data, graphics, images, information, suggestions, guidance, and other material (collectively, “Information”) that may be available on the Website (including information provided in direct response to your questions or postings) may not be provided by individuals in the medical profession. The provision of such Information does not create a licensed medical professional/patient relationship, between Lifeline and you and does not constitute an opinion, medical advice, or diagnosis or treatment of any particular condition, but is only provided to assist you with locating appropriate medical care from a qualified practitioner.
  1. It is hereby expressly clarified that, the Information that you obtain or receive from Lifeline, and its employees, contractors, partners, sponsors, advertisers, licensors or otherwise on the Website is for informational purposes only. In no event shall Lifeline be liable to you or anyone else for any decision made or action taken by you in reliance on such information.
  1. The Services are not intended to be a substitute for getting in touch with emergency healthcare. If you are a member facing a medical emergency (either on your or another person’s behalf), please contact an ambulance service, hospital, doctor or appropriate medical professional directly.
  • The Information does not constitute an invitation or recommendation to take medical services from Lifeline or its Partners nor is such Information a substitute for professional advice or solicitation in respect of medical services/ products or recommendation thereof. Lifeline urges the Users to seek the advice of professionals, as appropriate, regarding the evaluation of any specific opinion, advice, product, service, or other Information.
  • All information on the Website is provided to you “as is” without warranty of any kind either express or implied including, but not limited to implied warranties of merchantability and fitness for a particular purpose, title, non-infringement, security or accuracy. In no event shall Lifeline or its Partners be liable for any special, direct, indirect or consequential damages or any damages whatsoever resulting from loss, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance of information.
(c)             Limitation of Liability.    The information available on the Website or Webpage could include inaccuracies or typographic errors. Lifeline has endeavoured to ensure that all the information on the Website is correct, but Lifeline neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data or information contained. Lifeline makes no warranty, express or implied, concerning the website or App and/or its contents and disclaims all warranties of fitness for a particular purpose and warranties of merchantability in respect of Services, including any liability, responsibility or any other claim, whatsoever, in respect of any loss, whether direct or consequential, to any user or any other person, arising out of or from the use of the information contained in the website.
  1. In no event shall Lifeline or its Partners be liable for any direct, indirect, punitive, incidental, special, consequential damages or any other damages resulting from:
(a) The use or the inability to use the Services; (b) Unauthorized access to or alteration of the User’s transmissions or data; (c)  Any other matter relating to the services; including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the website. Neither shall the Company be responsible for the delay or inability to use the Website, webpage, App, Services or any related services, the provision of or failure to provide services, or for any information, software, products, services and related graphics obtained through the Website or App, or otherwise arising out of the use of the Website or App, whether based on contract, tort, negligence, strict liability or otherwise. (d) Further, Lifeline shall not be held responsible for non-availability or access to the Website or App during periodic maintenance operations or any unplanned suspension of access to the Website that may occur due to technical reasons or for any reason beyond Lifeline control. The user understands and agrees that any material and/or data downloaded or otherwise obtained through the website is done entirely at his/her own discretion and risk and the User himself/herself will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data. These limitations, disclaimer of warranties and exclusions apply without regard to whether the damages arise from (a) breach of contract, (b) breach of warranty, (c) negligence, or (d) any other cause of action, to the extent such exclusion and limitations are not prohibited by applicable law.
  1. Indemnity. User agrees to indemnify and hold harmless Lifeline, its affiliates, officers, directors, employees, consultants, licensors, agents, representatives and Partners from any and all third party claims, losses, liability, damages, and/or costs (including reasonable attorney fees and costs) arising from User’s access to or use of Service, violation of this Agreement, or infringement, or infringement by any other User of his/her/its account, of any intellectual property or other right of any person or entity. Lifeline will notify you promptly of any such claim, loss, liability, or demand, and in addition to your foregoing obligations, you agree to provide us with reasonable assistance, at your expense, in defending any such claim, loss, liability, damage, or cost.
  1. Severability. If any provision of the Agreement is held by a court of competent jurisdiction or arbitral tribunal to be unenforceable under applicable law, then such provision shall be excluded from this Agreement and the remainder of the Agreement shall be interpreted as if such provision were so excluded and shall be enforceable in accordance with its terms; provided however that, in such event, the Agreement shall be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by such court of competent jurisdiction or arbitral tribunal.
  1. Waiver. No provision of this Agreement shall be deemed to be waived and no breach excused, unless such waiver or consent shall be in writing and signed by Lifeline. Any consent by Lifeline to, or a waiver by Lifeline of any breach by you, whether expressed or implied, shall not constitute consent to, waiver of, or excuse for any other different or subsequent breach.
